FEMA/NFIP has just issued a bulletin (w-12017) stating NFIP policy regarding underwriting and claims coverage standing when buildings or property are built over water. This is particularly important because of recent ongoing litigation on point. Please appreciate that this is not just an issue for coastal properties, but equally applies to buildings and properties that are built over the water of lakes, rivers, inlets and the like, and in both original construction date is critical.

Also, please see March 5 WaterMarkfor an article giving the latest status and explanation of FEMA/NFIP efforts on levee certification. It is the federal government’s desire to have all levies recertified. FEMA teams are going into communities to create these assessments, generally (but not always) in league with an NFIP remapping process. This may very well change the flood rating zone of areas behind these levies. This article and referenced resources are designed to assist NFIP producers and their communities through this process. PIA National NFIP representative Richie Clements (LA) will also discuss a number of issues connected to this levee process at the upcoming Flood Insurance Producers National Committee (FIPNC) and Institute for Business and Home Safety (INHS) meetings with FEMA/NFIP officials in mid-March. Additional information will follow those meetings.

PIA National appreciates the onslaught of FEMA/NFIP bulletins in the last 12-18-months which can present as information overload. These bulletins are being issued as a direct result of all the issues coming to light in the course of the NFIP addressing the large number of claims generated by the largest number of flooding events in U.S. history in 2011.PIA National continues to monitor these bulletins and will issue alerts as needed.
