FEMA/NFIP Delays Next-Set of Biggert-Waters Changes

Further implementation of reforms to the National Flood Insurance Program (NFIP) mandated by the Bitters-Waters Act are being delayed by FEMA/NFIP.

Further implementation of reforms to the National Flood Insurance Program (NFIP) mandated by the Bitters-Waters Act are being delayed by FEMA/NFIP. The new time frame for changes under Section 10025 – originally set for August 1, 2013 – has been pushed back to October 1, 2013. Section 100205 provides for additional underwriting and further rate reforms to continue moving the NFIP program toward a sound financial position.

FEMA/NFIP announced this change for several reasons, but the three most significant ones are:

  1. Federal Sequestration will slow down the working progress of the agency;
  2. The timing adjustment better retains the twice-yearly rhythm of when WYOs receive and integrate such changes;
  3. It gives Sandy impacted areas and policyholders a bit more breathing room.


We have included the earlier bulletin (w-12109), superseded by w-13012, for your information, for three reasons:

    1. It provides an excellent detail of what the full scope of Section 100205 of Biggert Waters reforms intended to accomplish. This makes it a good reference point for PIA members writing NFIP business.
    2. It is suspected that the scope of reform changes that FEMA/NFIP will implement on 10-01-13 (and announce 04-01-13) will not be as comprehensive as those addressed by the original December 2012 bulletin.
    3. Thus, comparison between the two will give PIA members a good working sense of what more should be anticipated for this section’s reforms in 2014 (along with other reforms yet to be addressed).
