Federal regulators will not require an employer-sponsored health plan with just one member who is a current employee, or no member who is a current employee, to meet health market change mandates. Officials responding to a question posed by the Employee Benefits Security Administration reiterated that the Health Insurance Portability and Accountability Act (HIPAA) of 1996 exempts groups with fewer than two participants who are current employees from provisions in group health plans. Officials answered "yes" when asked whether the same HIPAA statutory exemption will apply to provisions in the Affordable Care Act that are intended to enhance the group market.
