Supreme Court Decision on ACA Subsidies Imminent

A decision is expected to be announced in the next few days on a challenge to the Affordable Care Act (ACA) that could deal a blow to one of President Obama's signature programs. The U.S. Supreme Court is set to announce its decision in King v. Burwell, in which plaintiffs contend the Obama administration is unlawfully providing subsidies to people buying health insurance in approximately 34 states using healthcare.gov, rather than having established their own state exchange. The challenge is based on one phrase in one place in the 1,000-page health insurance reform law which references exchanges "established by the State" regarding subsidies.

The Supreme Court has designated three days for the announcement of decisions prior to adjourning for the summer: Thursday June 25; Friday June 25; and Monday June 29. There is no clear indication of how the court may rule. PIA National will be out with analysis and commentary—no matter which way the decision goes.
