The Fourth Circuit Court has requested a response from the Office of the Comptroller of the Currency (OCC) to PIA's petition for a rehearing in our legal challenge to the OCC. PIA initially filed a brief intervening in a lawsuit by the state of West Virginia against the OCC in which we asked the court to declare null and void the OCC's preemption of four consumer protection provisions in the West Virginia Insurance Sales Consumer Protection Act. The court ruled against PIA 2-1, prompting us to file for the rehearing. The court has given the OCC until January 28, 2003 to file its response.

PIA already has a lawsuit pending against the OCC on the same issue in the U.S. District Court for the District of Columbia and has filed a friend-of-the-court brief in an action involving a similar OCC preemption opinion in Massachusetts.
