Trial Lawyers Vow to Challenge New Florida Malpractice Law

Florida's trial lawyers are promising to challenge a new state law that caps the amount of money malpractice victims can receive for pain and suffering. Governor Jeb Bush (R) signed the bill August 14. The compromise plan limits a doctor's liability for non-economic damages, chiefly pain and suffering, in most malpractice cases to $500,000. A medical facility's liability will be limited to $750,000 in most cases.  Multiple victims-such as a victim, a spouse and their children-will be able to receive more money, but no group of victims could win more than $2.5 million. Economic damages, such as for medical costs and lost wages, would not be capped.
