The State Supreme Court in New Jersey has ruled unanimously that uninsured drivers cannot sue if they are injured in an accident, even if another driver was at fault. The February 19 ruling upholds a 1997 state law that bars such suits, and overturned lower court rulings that said the law was unconstitutional. Justice Barry Albin wrote the decision, which said in part, "The uninsured driver forfeits the right to sue by failing to comply with a necessary precondition to filing suit: maintaining insurance coverage."
