The Department of Labor's (DOL's) Wage & Hour Division has released a notice of proposed rulemaking (NPRM) to amend overtime regulations under the Fair Labor Standards Act (FLSA). Based on an initial review of the rule, PIA is concerned that the proposed regulations will have unintended consequences for insurance agents and agencies.

"Regulating under the FLSA, which was enacted in 1938, for a 21st century economy poses significant challenges," said PIA National Counsel & Director of Regulatory Affairs Jennifer Webb. "We are concerned that the proposed regulation, while well intentioned, will be unnecessarily burdensome for PIA member agencies leading to decreased opportunity and flexibility for agency employees. We need to reduce the hardships that small businesses already face, not compound them." The 295-page NPRM outlines the proposed changes and can be found here.
