WASHINGTON — The Department of Labor’s Wage & Hour Division has released a notice of proposed rulemaking (NPRM) to amend overtime regulations under the Fair Labor Standards Act (FLSA). Based on an initial review of the rule, the National Association of Professional Insurance Agents (PIA) is concerned that the proposed regulations will have unintended consequences for insurance agents and agencies.

“Regulating under the FLSA, which was enacted in 1938, for a 21st century economy poses significant challenges,” said PIA National Counsel & Director of Regulatory Affairs Jennifer Webb. “We are concerned that the proposed regulation, while well intentioned, will be unnecessarily burdensome for PIA member agencies, leading to decreased opportunity and flexibility for agency employees. We need to reduce the hardships that small businesses already face, not compound them.”

PIA will be commenting on this proposed rule on behalf of the insurance agents we represent across the country. PIA is also a member of the Partnership to Protect Workplace Opportunity (PPWO), which consists of a diverse group of associations, businesses and other stakeholders representing employers with millions of employees across the country in almost every industry.

The 295-page NPRM outlines the proposed changes and can be found here.

Founded in 1931, PIA is a national trade association that represents member insurance agents and their employees who sell and service all kinds of insurance, but specialize in coverage of automobiles, homes and businesses. PIA members are Local Agents Serving Main Street AmericaSM. PIA’s web address is www.pianet.com.
